TERMS AND CONDITIONS OF USE OF THE EBOVAC2 INTRANET


Introduction

Ebovac2 Intranet is a private website of a collaborative project, only accessible to identified members of Ebovac2 consortium and the Independent Advisory Board (called “the Experts”) of Ebovac2 through individual login and password. “The Experts” are identified members who have signed a confidentiality agreement with the Ebovac2 Consortium in order to advise them during the project. Ebovac2 Intranet is an online repository whose purpose is the sharing/storage of confidential documents related to Ebovac2 project.

Inserm Transfert’s team, as administrator, has the responsibility of the Intranet management but all the members of Ebovac2 consortium contribute to its content and the disclosure of information. Inserm Transfert process and store on an “as is” basis the documents and information provided by the consortium. So, you will access to documents and information according to your access rights.


Access Rights

To access the Ebovac2 Intranet, you will create a user login and password. Your access will be granted by the administrators according to the access rights entitled by your status: members, WP Leaders of Ebovac2 consortium and/or Experts, such as:

  • View
  • Download
  • Upload (except for “the Experts”)
  • Modify some content

Important notice: Please, only upload documents related to Ebovac2 project and useful to other members (it is not a personal repository).

“The Experts” have a restricted access to Ebovac2 Intranet. They are not allowed to view all the documents shared and they cannot upload any document.

Only administrators and/or WP Leaders can create and/or delete folders, and/or delete documents. Deletion of an uploaded document will be done only in the following cases:

  • Update of the document: a recent version of the same document is available
  • On request of the member who has uploaded the document

For security reasons and to keep the confidentiality of the shared documents, your login data (username and password) may not be communicated to anybody else. Please keep these data secret and never share them with any third party.
If you forgot your username or password, you can reset it on the ‘Sign in’ page by clicking “Forgot your password?” Or “Forgot your username?”.

Ownership of shared documents

All the documents and information available on Ebovac2 Intranet are confidential and are strictly restricted to the members of Ebovac2 consortium. These information are protected by intellectual property laws agreed in the Grant agreement.
You are not allowed to communicate or disseminate the documents and/or information accessible on the Intranet without the explicit and written permission of Ebovac2 consortium.

Also, note that all dissemination should comply with the rules accepted in the Grant agreement and Consortium agreement.


Acceptance of terms

To access the Ebovac2 Intranet, repository of all Ebovac2 documents, you should consent this terms to activate your account. By using the Ebovac2 Intranet, you agree that the posting of new or revised documents, for which your access is granted, shall generate electronic notice to you.

By accessing and using the Ebovac2 Intranet, you agree to be bound by the Terms and conditions of the Ebovac2 Intranet as well as the Intranet Privacy Policy, which you acknowledge that you have read and understood.

This Policy (together with the Legal notice and any other documents referred to in it) sets out the basis on which any personal data collected from you, or provided by you, will be processed. Please, read the following carefully to understand our practices regarding your personal data and how it will be treated. By using the secured and dedicated extranet of Ebovac2 you are accepting and consenting to the practices described in this Policy.
Inserm Transfert is currently acting as the manager for the extranet infrastructure, but each partner of Ebovac2 contribute to the content and information disclose.
Any subsequent reference to Inserm Transfert in these terms shall include the Ebovac2 partners from time to time involved in the project. However, unless expressly provided otherwise, the liability of Ebovac2 partners in connection with Ebovac2 or the site shall be several and extend only to any loss or damage arising out of their own acts and omissions.

 

1. General information about the processing of personal data
For the purpose of Ebovac2, we have set up and launched a specific secured and dedicated extranet. To this end, Inserm Transfert will need to collect, store and process your personal data for the legitimate purposes of the Ebovac2 knowledge/information management and for sharing internal information among all partners.
Access to the Ebovac2 extranet is strictly restricted to identified members of the project. To access to the Ebovac2 extranet, repository of all Ebovac2 documents, you should consent to activate your account.

 

2. Commitment
Inserm Transfert is the “data controller" for the information that you provide to us when visiting Ebovac2 website. This means that we decide how to use it and are responsible for looking after it in accordance with the GDPR.

Inserm Transfert undertakes to process all data transmitted or collected in a manner that complies with the applicable “Regulations”.

 

3. Collection, Use & Disclosure of Personal Data
To enable you to use Ebovac2 Extranet and get access to information restricted to project partners, we shall need some personal data of you. Within the framework of registration to Ebovac2 Extranet we shall need for your first name, surname as well as your business email address. We will only retrieve your personal data when you voluntarily provide these to us within the framework your registration with the Ebovac2 Extranet.
Inserm Transfert will exclusively employ your personal data to give you access to the Ebovac2 Extranet. We will not disclose your personal data to any third parties without first obtaining your consent permitting us to do so.

 

4. Administration and Management of Personal Data

a. Administration of Personal Data
In order to be able to use the functionality of the Extranet you must enter some personal data which we process and store, as on the basis of this information you will access to documents and information according to your access rights.
You can administer your own personal data at any time Under “My Profile” page.

b. Management of Personal Data and security measures
Inserm Transfert will take appropriate measures to keep your personal data accurate, complete and updated.

Inserm Transfert will also take reasonable efforts to take appropriate precautions and preventive measures to ensure that your personal data is adequately protected and secured. Appropriate security arrangements will be taken to prevent any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data.
Inserm Transfert will also take reasonable efforts to ensure that the personal data in its possession or under its control is destroyed as soon as it is reasonable to assume that (i) the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and (ii) retention is no longer necessary for any other legal or business purposes.

You may, at any time and for any reason, delete contributions from the collaborative work space and withdraw Inserm Transfert’s right to use such contributions, but you accept that such contributions may have been downloaded and used by other users in the collaborative workspace and Inserm Transfert has no control over the use of any contributions which may have been downloaded or copied from the collaborative work space by other users.
Inserm Transfert acknowledges the importance of preserving your access to contributions held in a collaborative work space. If no one has logged into a collaborative work space within 36 months or Inserm Transfert discontinues the provision of collaborative work spaces Inserm Transfert will, where reasonably possible, give you reasonable advance notice and a chance to remove any contribution from a collaborative work space.
Note: For security reasons your login data (user name and password) may not be communicated to anybody else. Please keep these data secret and never share them with any third party.

 

5. Declarations of Consent, where applicable
Pursuant to the General Data Protection Regulation (GDPR) Article 4 you have expressly given us the following declaration(s) of consent within the framework of your registration to our portal and we have recorded your consent. Pursuant to the General Data Protection Regulation (EU Regulation 2016/679) (GDPR) and the French Data files and Individual Liberties defined by Law no. 78-17, as amended, we are obliged to provide the content of the declarations of consent anytime on demand. You may revoke your declaration(s) of consent anytime with future effect.

 

6. Registration with the Portal and consent
I wish to register for the future use of the data portal and request admission and storage of my provided data into your portal data base.
I have taken notice of the conditions of usage of the Ebovac2 Extranet data portal, I understood and agree to these.

 

7. Request for Access, Correction and/or Withdrawal of Personal Data
Pursuant to the General Data Protection Regulation (GDPR) Art. 15 Right of access and the French law Informatique et Libertés, you have the right to access information held about you. For this reason, you can access information concerning the data stored in Ebovac2 Extranet and managed by Inserm Transfert at any time without providing any reasons. As part of the GDPR you may request that your personal data is corrected or deleted. The result of a deletion request will revoke your access to the Ebovac2 extranet.

3. DEFINITIONS

The processing of personal data is an organized set of operations carried out on personal data (collection, structuring, preservation, modification, communication ...).

The data controller is the person who decides how the processing of personal data will be implemented, including determining what the data will be used for and what tools will be used to process it.
The subcontractor is the one who performs data operations on behalf of the data controller, it signs a contract with the controller that entrusts him with certain tasks and ensures that it has the technical and organizational guarantees, allowing it to process the personal data entrusted to him in accordance with the “Regulations”.


4. CATEGORIES OF PERSONAL DATA COLLECTED AND PROCESSED

In application of the minimization principle of the GDPR, only strictly useful personal data are collected and processed. Inserm Transfert collects and processes only personal data that are voluntarily transmitted to him.
The information that can be collected are:

  • The business data of the Person concerned: last name, first name(s), e-mail, function, address, professional and/or personal telephone number.
  • Browser data of the Person concerned using the Inserm Transfert’s website: Information collected via Cookies and Navigation data.

 

5. PURPOSES OF TREATMENTS

1. Contact us
We process your data to provide you with the services and/or information you have requested using Ebovac2 “Contact us” form or by contacting us electronically.

The information you enter in this form or send by email is intended for Inserm Transfert as “Data controller”. Inserm Transfert undertakes not to disclose to third parties the information and personal data communicated to it. These are confidential and will only be used for the purposes of processing your request.

2. Newsletter
We process your data (i.e email address) to send you the monthly/quarterly/annually newsletter of the [name of the project].
We do this only where you have specifically indicated that you consent to receive such communications and subscribe to receive the newsletter for example, when you register to the site e.g. by ticking the consent box. However, this will not affect the lawfulness of any processing carried out before your withdrawal of consent and you may no longer be able to use the site in the same way you did before.

3. Audience measurement
For its audience measurement, the site uses cookies such google analytics. This information, which is related to navigation and gathered and kept by Inserm Transfert, is neither given to third parties nor used for any other purposes. You can disable it using the google analytics opt out browser.


6. TRANSFER OF PERSONAL DATA COLLECTED

According to the above and apart from the need to disclose personal data to companies whose intervention as third party service providers on behalf and under the control of Inserm Transfert is required for these purposes, Inserm Transfert will not transmit any personal data collected in this context, neither sell, rent nor exchange them with any organization or entity, unless you have been informed beforehand and/or that you have explicitly given your consent or, unless required by law, for example in a legal proceeding.

Personal data are not transmitted to third countries or to international organizations outside the European Union. Third parties, service providers are subject to the same rules of confidentiality.

 

7. SECURITY MEASURES

To the extent possible, to prevent unauthorized access to personal data collected in this context, appropriate technical and organizational measures to safeguard the security, integrity and confidentiality of your Personal Data are being place. These procedures concern both the collection, the preservation and the access to these data, so as to prevent their damage, deletion or access by unauthorized third parties, intentionally, accidentally or unlawfully.
Access to your personal data is strictly limited to employees and staff authorized by reason of their duties and bound by the obligation of confidentiality and, where applicable, by subcontractors. The partners in question are subject to an obligation of confidentiality and may use your data only in accordance with our contractual provisions and the applicable legislation.

Except as provided above, we will not sell, rent, assign or give access to third parties to your data without your prior consent, unless we are compelled to do so (legal obligation, etc.). However, the data collected may possibly be communicated to subcontractors who are contractually responsible for carrying out the tasks necessary for the proper functioning of Inserm Transfert and its services and for the proper management of the relationship with you, without you need to give your permission. It is specified that, in the context of the performance of their services, the subcontractors have only limited access to your data and have a contractual obligation to use them in accordance with the provisions of the applicable legislation on personal data protection.

 

8. RETENTION PERIOD

Inserm Transfert has laid down precise rules concerning the retention period of personal data, in order to limit the retention to a period strictly necessary. At the end of the fixed period, the personal data will be, as the case may be, deleted or archived, in compliance with the applicable “Regulations”.

You also have the right to request for the transfer of your data to another party.

You may also, for legitimate reasons, object to the processing of your personal data, as long as this does not interfere with the operation of Inserm Transfert.
